Welcome to SeniorCareDesigner. These Terms and Conditions (“Terms”) govern your access to and use of seniorcaredesigner.com (the “Site”) and any templates, designs, or content purchased or accessed through it (“Products”). The Site is operated by SeniorCareDesigner (“we,” “us,” or “our”).
By accessing the Site or purchasing a Product, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Site or purchase Products. By using the Site, you represent that you meet these requirements.
2. Account Registration
Certain features, such as purchasing and re-downloading Products, may require you to create an account. You agree to:
- Provide accurate and current information
- Keep your login credentials confidential
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Products and Purchases
- All Products sold on the Site are digital design templates delivered via a Canva template link or downloadable file — no physical goods are shipped.
- Prices are listed in [Insert Currency] and are subject to change without notice. The price at the time of purchase is the price you pay.
- Payment is processed securely through our third-party payment processor. We do not store full payment card details.
- Upon successful payment, you will receive access to the Product via email and/or your account dashboard.
4. License to Use Products
Purchasing a Product grants you a limited, non-exclusive, non-transferable license to use the design for your own senior living facility, company, or organization’s marketing purposes, subject to the following restrictions. You may not:
- Resell, redistribute, sublicense, or share the original template file with any third party, including other facilities, agencies, or designers
- Claim the design as your own original work for resale (e.g., listing it on another template marketplace)
- Use the design to create a competing template product
- Use the design in a way that is unlawful, defamatory, or misleading
Full licensing terms are detailed in our [License Terms]. If licensing terms conflict with these Terms, the License Terms govern for matters specific to Product use.
5. Refunds
All purchases are subject to our [Refund Policy]. Because Products are digital and delivered instantly, refunds are limited to specific circumstances outlined in that policy.
6. Intellectual Property
All content on the Site — including template designs, graphics, logos, text, and the Site’s overall look and feel — is the property of SeniorCareDesigner or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted upon purchase (Section 4), nothing in these Terms transfers ownership of any intellectual property to you.
7. Prohibited Uses
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, other user accounts, or our systems
- Copy, scrape, or reproduce Site content for purposes other than your own licensed use of purchased Products
- Upload or transmit viruses, malware, or other harmful code
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
We reserve the right to suspend or terminate access to the Site for anyone who violates these Terms.
8. Third-Party Services
Products are designed for use with Canva, a third-party platform not owned or operated by us. Your use of Canva is subject to Canva’s own terms of service. We are not responsible for outages, changes, or issues arising from third-party platforms.
9. Disclaimer of Warranties
The Site and Products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, SeniorCareDesigner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or Products, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the Product giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless SeniorCareDesigner, its owners, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party right, including licensing restrictions on Products.
12. Changes to the Site or Terms
We reserve the right to modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time; changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
